Consulting vs. Therapy Disclaimer
Section 1: Purpose and Role
I, R. Alex Colston, LMFT, am a licensed marriage and family therapist in the state of KY. However, the services provided under this agreement are consulting services only.
My role in this relationship is exclusively as a consultant/coach, and I am not acting as your therapist, counselor, or medical provider. You are not a client under my care.
These services are for educational, informational, and goal-oriented purposes only and do not constitute mental health treatment, psychotherapy, or medical advice.
Section 2: Scope of Work
Our work will focus on identifying and explaining your Attachment Style and your experience of Burnout, not on diagnosing or treating mental health disorders.
No clinical assessment, diagnosis, or treatment plan will be provided.
Consulting assumes the client is whole and capable of reaching their own defined outcomes, rather than addressing past psychological wounds or trauma.
Section 3: No Patient-Provider Relationship
Engagement in these consulting services does not establish a doctor-patient or therapist-client relationship. I will not maintain clinical records for these sessions.
You acknowledge that you are not receiving a medical service and that these sessions are not covered by health insurance.
Section 4: Mandated Referral and Crisis
Consulting is not appropriate for individuals in crisis or acute distress.
If clinical needs or mental health issues arise, I am obligated to refer you to a licensed mental health professional for appropriate care.
Section 5: Confidentiality and Legal Privilege
While I maintain business confidentiality, consulting does not carry the same legal privilege as therapy.
My consulting records may be subject to subpoena in ways that clinical therapy records are not.
However, since I do not maintain assessment result records, under a subpoena, I can only provide date of purchase of the consulting service.
PROFESSIONAL SERVICES AGREEMENT (CONSULTING)
This Professional Services Agreement (“Agreement”) is entered into on date of consulting service purchase, by and between R. Alex Colston, LMFT, LLC (“Consultant”) and Client who purchases the consulting service (“Client”).
1. Scope of Services
Consultant agrees to provide the following consulting services:
An attachment style assessment form via this website and will generate PDF results to be sent to the client; no records will be stored electronically or in hard copy by the consultant except for any sales receipts of the client.
Services will be delivered via forms collected on this website and form results sent to client by email for a duration of 30 days.
2. Non-Therapeutic Relationship
No Therapy: Client acknowledges that Consultant is a licensed marriage and family therapist in the state of KY. However, Client explicitly understands that the services provided under this Agreement are Consulting, not therapy or mental health counseling.
No Diagnosis: No clinical assessment, mental health diagnosis, or treatment of any psychological disorder will be provided.
No Therapist-Client Relationship: This Agreement does not create a doctor-patient or therapist-client relationship. Consultant is not acting as Client’s healthcare provider.
Referral Requirement: If Consultant determines that Client’s needs fall outside the scope of consulting (e.g., clinical distress, trauma, or mental health crisis), Consultant will require Client to seek services from a separate licensed mental health professional.
3. Fees and Payment
Investment: Client agrees to pay $97 for the Attachment Audit and/or $1200 for the consulting package.
No Insurance: Client understands that consulting is not a "medically necessary" service. Consultant will not provide CPT codes, "superbills," or any documentation for insurance reimbursement.
Refund Policy: All sales are final for the Consulting Package. Client may request a reimbursement for the Attachment Audit if sufficient evidence is provided to the Consultant that the assessment has not bee completed. All requests for refunds of the Attachment Audit must be within 30 days of the date of purchase.
4. Confidentiality and Records
Privacy: Consultant will maintain the confidentiality of all business and personal information shared by Client.
No Privilege: Client acknowledges that "Consultant-Client" communications do not carry the same legal "privileged communication" status as "Therapist-Patient" communications. Consultant may be legally compelled to disclose records in a court of law. The only records stored by the Consultant are receipts of purchase.
Mandated Reporting: Notwithstanding the above, Client understands that as a licensed professional, Consultant is legally required by state law to report suspected child/elder abuse or situations involving an immediate threat of harm to self or others.
5. Limitation of Liability
Client agrees that Consultant’s total liability for any claim arising out of this Agreement shall not exceed the total amount paid by Client for the services. Consultant provides no guarantees regarding specific outcomes or results from the consulting process.
6. Governing Law
This Agreement shall be governed by the laws of the State of Kentucky.
